The Second Major Sin
MURDER
Allah said; And whoever kills a believer intentionally, his recompense is Hell to abide therein; and the wrath and the curse of Allah are upon him, and a great punishment is prepared for him. (Al-Nisa'i 93)
He said regarding the servants of The Most Merciful, those who do not call upon any other god together with Allah, nor kill any person whom Allah has prohibited (killing) except in (the course of) justice, nor commit fornication (or adultery). And whoever does that will incure guilt; the punishment will be doubled for him on the day of resurrection and he will remain in it forever, disgraced, excepting the one who repents and believes and acts righteously. (Al-Furqan 68-70)
On account of that (the killing of one of the decendants of Adam by his brother), we prescribed for the children of Israel that if someone if someone kills a person unless it is in (retaliation) for the murder of another or spread corruption on earth, it will be as if he had killed the whole mankind (Al-Ma'idah 32)
When the girl who was buried (alive) is asked for what crime she was killed... (Al-Takweer 8-9)
The Prophet said (avoid the seven noxious things) and he mentioned amomg them, "killing one whom Allah has declared inviolate without a just cause"
A man asked Allah's messenger what was the greatest sin in Allah's sight, to which he replied, "That you should treat anything as equal to Allah, when He Has created you" what next he asked, to which the Prophet replied, "to kill your child for fear that he may eat along with you." what next he asked, to which he replied "you should commit adultery with your neighbor's wife." and Allah Most High Has revealed words which verify this: "Those who do not invoke another god along with Allah, or kill one whom Allah has declared inviolate without a just cause, or commit fornication (or adultery).
The Prophet said: "when two muslims meet with their swords, the one who kills and the one who is killed will go to hell. He was asked, Messenger of Allah, That one was the killer, what was the fault if the one who was killed?, He replied "He was also eager to kill his companion". (Bukhari, Muslim and Ahmad bn Hambal)
In explaining the above hadith, Imam Abu Sulaiman (Yahya bn Ya'amar) says: This is when the two muslims are not fighting each other for some legitimate cause, but rather for the sake of personal enmity or group partisanship, wealth, leadership or fame. But if someone is fighting a rebellious group for a reason which makes fighting them necessary, or in protection of his wealth or family, he is not included in this hadith. Because he is forced to protect himself with no intention of killing his attacker if the attacker does not intend killing him. If the attacker were to flee from the fight, then he shouldn't follow him to kill him. The hadith does not apply to one fighting for a just cause, but applies to the above mentioned cases. Allah Knows Best.
The Messenger said "do not revert to disbelieve after me and cut off one another's heads."
He also said: "A believer would continue to find ample scope in his religion as long as he does not kill anyone unlawfully." (Bukhari, Muslim, Tirmidhi, Ibn Majah and Nasa'i), He said "Shedding of blood would be the first issue upon which judgement would be given on the day of judgement." (Bukhari and Muslim), He said "The passing away of the world is less in the sight of Allah compared to the murder of a believer." (Nisa'i and Baihaki), He said "(Among) The major sins are associating anything with Allah, murder and deliberate perjury" (Bukhari, Muslim and Nasa'i), He said "No life is unjustly taken except upon the first son of Adam a portion of the injustice because he was the first to commit murder" (Bukhari and Muslim), he said "whoever kills a person who has made a covenant (a Christian or jew under the protection of Islam due a covenant) would not perceive the fragrance of Jannah, and its fragrance is perceived from a distance of forty years journey" (Bukhari)
If this is the case regarding killing a person who had made a covenant, which is either a jew or Christian who is resident on a land governed under the Islamic jurisdictions, what would be situation regarding killing a Muslim?
Allah's Messenger said: "Beware! Whoever kills a person who has made a covenant, whose life is guaranteed by Allah and His Messenger has broken Allah's guarantee and as such would not perceive the fragrance of Jannah, it's fragrance is perceived from a distance of fifty year's journey" (Tirmidhi).
He said: "if anyone helps in the murder of a Muslim (even if it is) by a word would meet Allah with "Despairing of Allah's Mercy" written on his forehead." (Ahmad)
Mu'awiyah reported that Allah's Messenger said: "All sins may be forgiven by Allah except for a person who dies a polytheist or a person who intentionally kills a believer." (Nasa'i and Hakim)
